STATUS HUKUM DAN PENGELOLAAN DANA NON HALAL HOTEL SYARIAH PERSPEKTIF HUKUM EKONOMI SYARIAH

sharia backgrounds are now increasingly widespread, including in the hospitality sector which is run based on sharia economic law. In its development, sharia hotels can be the most sought-after alternative by foreign and domestic tourists and even become a separate requirement for Indonesia as a country with a quantitative population of Muslims. This study aims to find out the legal status and management strategies for sharia hotel non-halal funds in terms of sharia economic law. Based on its type, this study is in the qualitative category with descriptive analysis techniques through literature review (book research). The method used is empirical normative through a juridical approach. The results of the study show the significance of the full involvement of DSN and DPS to guarantee hotel services from the sharia aspect. The legal status of non-halal funds is halal, as long as they are intended for public needs. The strategy for managing non-halal funds is carried out by functionalizing PSAK 101 (separation and comparison function), Tafriq ash-shafqah, mashlahah 'ammah, aujuh al-khair, tashrif al-'ammah. As a recommendation, hotel management in this case must provide services that are impartial and friendly to the sharia economic law system which is internalized in infrastructure, accommodation, restaurants, personal needs, consumption, travel, transportation travel agencies, and human resources, and all service units are halal certified.

ABSTRAKBertambah dan bertumbuhnya interaksi ekonomi, keuangan, dan bisnis dengan latar belakang syariah kini semakin marak, termasuk di bidang perhotelan yang dijalankan dengan berbasis hukum ekonomi syariah. Dalam perkembangannnya, hotel syariah dapat sebagai alternatif paling dicari oleh para turis asing dan domestik dan bahkan menjadi kebutuhan tersendiri bagi Indonesia sebagai negara yang secara kuantitas penduduknya Muslim. Penelitian ini bertujuan untuk menemukan status hukum dan strategi pengelolaan dana non halal hotel syariah ditinjau dari hukum ekonomi syariah. Bedasarkan jenisnya, kajian ini kategori kualitatif dengan teknik analisis deskriftif melalui kajian literatur (book research). Metode yang digunakan adalah normatif empiris melalui pendekatan yuridis. Hasil penelitian menunjukan signifikansi keterlibatan penuh DSN dan DPS untuk menjamin layanan hotel dari aspek syariahnya. Status hukum dana non halal adalah halal, selama diperuntukan bagi kebutuhan hajat umum. Strategi pengelolaan dana non halal dilakukan dengan fungsionalisasi PSAK 101 (fungsi pemisahan dan perbandingan), Tafriq ash-shafqah, mashlahah ‘ammah, aujuh al-khair, tashrif al-‘ammah. Sebagai rekomendasi, manajemen hotel dalam hal ini mesti menyediakan pelayanan yang berpihak dan bersahabat dengan sistem hukum ekonomi syariah yang terinternalisasi dalam infrastruktur, akomodasi, restoran, kebutuhan pribadi, konsumsi, travel, biro perjalanan transfortasi, serta sumber daya manusia (human resources), dan seluruh unit pelayanan tersertifikasi halal.Â
