Pertanggungjawaban Pidana Bagi Pelaku Tindak Pidana Aborsi ditinjau Dari Undang-Undang Nomor 36 Tahun 2009 Tentang Kesehatan (Studi Pada Putusan Nomor 52/Pid.B/2019/PN Bar)

Salah satu tindak pidana yang masih marak dilakukan adalah tindak pidana aborsi sesuai pada Putusan Nomor 52/Pid.B/2019/PN Bar. Penelitian ini bertujuan untuk mengetahui pertanggungjawaban pidana bagi pelaku tindak pidana aborsi dalam Putusan Nomor 52/Pid.B/2019/PN.Bar ditinjau dari Undang-Undang Nomor 36 Tahun 2009 Tentang Kesehatan. Metode penelitian yang digunakan dalam jurnal ini yaitu penelitian yuridis normatif dengan teknik pengumpulan bahan hukum menggunakan studi kepustakaan serta analisis bahan hukum menggunakan content analysis. Hasil penelitian menunjukkan bahwa pertanggungjawaban pidana pada Putusan Nomor 52/Pid.B/2019/PN Bar telah sesuai dengan tujuan pengaturan dalam Undang-undang Nomor 17 Tahun 2016 tentang perubahan atas Undang-undang Nomor 23 Tahun 2002 tentang perlindungan anak, namun tidak sesuai dengan tujuan yang termuat dalam Undang-undang kesehatan. Hal tersebut dikarenakan menurut penulis Majelis Hakim tidak memandang hal tersebut berdasarkan Undang-undang Nomor 36 tahun 2009 tentang kesehatan kesehatan, hanya berpandangan pada Undang-undang perlindungan anak saja.
